WHAT IS PACK UP + GO?

Pack Up + Go is a surprise travel agency. We plan getaways around the United States, but your destination is a surprise until the day you depart.

Pack Up + Go is an IATA accredited travel agency (39720833). Pack Up + Go is also an associate of WorldVia Travel Group, and is licensed to sell travel in all states.

HOW IT WORKS

You tell us your budget and complete a Pre-Trip Survey to tell us your travel preferences, and then we book your trip based upon this information.

We send customers to a wide range of destinations within the United States. For Plane Trips and Road Trips, travel destinations will be approximately 3 hours away from your departure city. However, in some cases travel time may be up to 6 hours away from your departure city or as low as 1.5 hours. Destinations will have public transportation and plenty of resources and activities to keep you busy during your visit. For You Pick Trips, travelers will choose the city they will explore.

For Plane Trips, Road Trips, and You Pick Trips, we guarantee that we will include one pre-planned activity.

For credit card security, all transactions are handled online via packupgo.com or travel.packupgo.com, with credit card processing completed securely through PayPal. We cannot accept orders made over the phone.

WHAT HAPPENS AFTER YOU SIGN UP?

  • As soon as you submit your Pre-Trip Survey and payment, you will automatically receive an order confirmation email.

  • Plane Trips:

    • You will receive an automated email reminding you of your upcoming Trip a few weeks before your departure date.

    • Exactly one week before you depart, you will receive another email from us with the weather forecast for your mystery destination, recommended items to pack, any luggage restrictions, and where to go and when for your departure.

      • For example, Newark Liberty Airport, Terminal C. Friday, August 17 at 8:00AM – your flight departs at 10:00AM!

    • At least one week before you depart, we will put an envelope in the mail using USPS 2-day Priority Mail. This envelope contains information about your destination, information about how to navigate the city, and recommended attractions and restaurants within your destination.

      • If, for some reason, your envelope does not get to you in time, please reach out and we will send all of the contents of your envelope by email.

      • Pack Up + Go is not responsible for any envelopes that are lost in the mail or delayed in transit as a result of USPS handling.

    • On the day of your departure, we will email your Trip Details.

  • Road Trips and Outdoors Road Trip Trips:

    • You will receive an automated email reminding you of your upcoming trip a few weeks before your departure date.

    • Exactly one week before you depart, you will receive another email from us with the weather forecast for your mystery destination, recommended items to pack, and recommendations about your departure time.

      • For example, Your drive time is around 4 hours, plus we’ll include some suggested stops along the way! You have an activity scheduled for 5PM, so we'd recommend getting started no later than 10AM.

    • At least, one week before you depart, we will put an envelope in the mail using USPS 2-day Priority Mail. This envelope contains information about your destination, custom Road Trip directions from your starting location to your accommodation, information on how to navigate the city, and recommended attractions and restaurants within your destination.

      • If, for some reason, your envelope does not get to you in time, please reach out and we will send all of the contents of your envelope by email.

      • Pack Up + Go is not responsible for any envelopes that are lost in the mail or delayed in transit as a result of USPS handling.

    • The day of your departure, we will email you with additional information about your getaway.

  • You Pick Trips:

    • You will receive an automated email reminding you of your upcoming You Pick Trip a few weeks before your departure date.

    • Exactly one week before your You Pick Trip, you will receive an email with the weather forecast and any packing recommendations.

    • At least one week before your You Pick Trip, we will put an envelope in the mail using USPS 2-day Priority Mail. This envelope contains information about your accommodations, tickets to an event/attraction, and recommendations within your You Pick Trip city.

WE OFFER FOUR TYPES OF TRIPS:

  • Plane Trips

    • Travel reservation included:

      • We will book your travel by plane. (Complete list of providers below.)

    • Accommodation reservation included

      • We book 2 types of accommodations:

        •  Hotel (Complete list of providers below.)

        •  Bed + Breakfast (Complete list of providers below.)

      • We will provide a curated list of recommendations based on the interests you’ve shared in your Pre-Trip Survey.

      • If there is leftover money in your budget after booking your travel, accommodations, and the Pack Up + Go service fee of 25%, we will include add-ons. This may include an Uber gift card, restaurant gift card, museum tickets, etc.

        • Please note that pre-planned activities for your trip are not guaranteed.

  • Road Trip - Travel reservation not included

    • Accommodation reservation in either a hotel or bed + breakfast.

    • Driving time to a destination is typically between 3-7 hours.

    • We will provide a curated list of recommendations based upon the interests you’ve shared in your Survey.

    • We will provide a guide for driving to your destination, including 2-3 roadside attractions to break up the drive.

      • Please note that these are simply recommendations!

    • If there is leftover money in your budget after booking your accommodations, and the Pack Up + Go service fee of 20%, we will include add-ons. This may include a restaurant gift card, museum tickets, etc.

      • Please note that activities for your trip are not guaranteed.

    • If you decline a rental car reservation, you must provide your own vehicle and gas

      • You must be a licensed driver with valid insurance

      • Gas and rental cars are not covered by your Trip budget

  • You Pick Trip - Travel reservation not included

    • The destination is not a surprise. You indicate on your Survey which city you will explore.

    • Accommodations will be a hotel.

    • We will provide a curated list of recommendations based on the interests you’ve shared on your Survey.

    • We will provide tickets to one surprise event or attraction in your selected city.

    • We will make a dinner reservation for you.

  • Outdoors Road Trip - Travel reservation not included

    • Accommodation reservation in a cabin, glamping tent, yurt, bed + breakfast, boutique hotel, or inn.

    • We will provide a curated list of outdoor recommendations + restaurants near your accommodations.

    • We will provide a guide for driving to your destination, including 2-3 roadside attractions to break up the drive.

      • Please note that these are simply recommendations!

    • If you decline a rental car reservation, you must provide your own vehicle and gas

      • You must be a licensed driver with valid insurance

    • All accommodations will include:

    • Running water

    • Bathroom

    • Bedding linens

    • Electricity

    • Pack Up + Go Outdoor Getaways are elevated outdoor experiences, you will not be camping in a basic tent or RV. Accommodation types are listed above.

    • Accommodation reservations are made in advance, and cannot be changed due to poor weather conditions.

    • While you may be near other glampers, your destination will not be an urban setting.

*Smoking is NOT permitted in any of our accommodations and may result in fines or expulsions from your accommodation.

Pack Up + Go reserves the right to send you to a destination not listed above.

If there are any specific cities you do not wish to visit on your trip with Pack Up + Go, please let us know on your Pre-Trip Survey and we will avoid it for your vacation.

WE DO NOT GUARANTEE:

  • Payments for your food, dining, or activities in your destination

    • *You Pick Trip will receive one activity with their reservation.

  • Tour guides within your destination

PEACE OF MIND REFUND ASSURANCE

Pack Up + Go’s Peace of Mind Refund Assurance enables you to change your travel dates or cancel your Pack Up + Go vacation at any time and for any reason prior to your scheduled departure, and receive a partial refund from Pack Up + Go as set forth in these Terms. Peace of Mind Refund Assurance is subject to the following requirements and restrictions, in addition to the general Pack Up + Go Terms of Use.

  1. If you have purchased Peace of Mind Refund Assurance for a Pack Up + Go Trip, you may cancel that Trip by reaching out directly to the Traveler Support Team by email (reservations@packupgo.com), or by phone (412-448-2700). No documentation is required to cancel the Trip.

    1. Any traveler on the reservation may make changes to a Trip, but must have the expressed permission by all members of the Trip to make such changes.

  2. Trip cancellations and date change requests must be received by Pack Up + Go at least 24 hours before your scheduled departure. Once checked in for flights, Pack Up + Go cannot guarantee rescheduling options or refunds.

  3. Any Trip cancellation or rebooking requests received after the originally scheduled departure will not be granted and refunds are not guaranteed.

  4. Upon canceling your trip with Peace of Mind Refund Assurance, Pack Up + Go will refund you a percentage of the total cost of your purchased Pack Up + Go Trip, as specified by the timing of the cancellation. Peace of Mind Refund Assurance does not guarantee a full refund of the entire Trip budget within four weeks of the scheduled departure date. 

    1. 4+ weeks prior to departure: 100% refund

    2. 4 weeks - 72 hours prior to departure: 80% refund

    3. 72 hours prior to departure: 75% refund

  5. If you need to change your travel dates with Peace of Mind Refund Assurance, your Trip will be rebooked for the dates specified. In the case of increased rates or fares, or change fees from suppliers, Peace of Mind will cover up to 2x the amount paid for your policy. If the fees associated with the date change exceed the amount covered, the traveler is responsible for paying the difference and will be invoiced via PayPal.

    1. New departure date must be 4+ weeks away from the current date and is subject to Pack Up + Go approval.

  6. Refunds will be issued back to the original form of payment used to book a Trip. Pack Up + Go will not issue refunds by check or cash. 

  7. In the event that the traveler is entitled to a credit from an airline, Pack Up + Go will provide the credit information directly to the traveler. Pack Up + Go is not responsible for rebooking travelers using airline credits for any trip other than a Pack Up + Go vacation. If travelers wish to use their airline credits for a personal vacation, they must contact the airline directly to rebook their flights using their credits. Any airline credits may be subject to a rebooking or change fee from the airline.

  8. Peace of Mind Refund Assurance must be purchased within 7 days of the original Trip booking.

  9. Peace of Mind Refund Assurance cannot be applied to only certain travelers on a Trip reservation; it must be added for all travelers or no travelers.

  10. If adding travelers to a Pack Up + Go vacation after the original booking is made, all new travelers must also purchase Peace of Mind Refund Assurance.

  11. The cost of Peace of Mind Refund Assurance is non-refundable. 

  12. If, due to conditions beyond our control, Pack Up + Go is unable to rebook the trip due to natural disasters, weather, pandemics, acts of God, terrorism, or any other unforeseen circumstances, Pack Up + Go is not responsible for providing rebooking alternatives. 

Refund + Rebooking:

  • Peace of Mind Refund Assurance covers costs up to 2x the amount paid for the policy, due to unforeseen circumstances during the trip or due to rescheduling. The traveler is responsible for any costs incurred in excess of that limit. 

  • In the event that an airline cancels or severely delays a flight (6+ hour delay from original departure time), Pack Up + Go will rebook the traveler on the next available flight on the original airline. If a rebooking option isn’t available on that airline, Peace of Mind will cover the cost of a new flight on a different airline up to 2x the amount paid for the policy. Travelers will be responsible for any costs incurred in excess of that amount. 

  • In the event that an airline cancellation causes the traveler to stay overnight in an airport hotel, Peace of Mind will cover the cost of an airport hotel up to 2x the amount paid for the policy. Travelers will be responsible for any costs incurred in excess of that amount. Payment will be made directly to the hotel.

  • In the event that an airline cancellation causes the traveler to rent a car to drive to their destination or home, Peace of Mind will cover the cost of the rental car up to 2x the amount paid for the policy. Travelers will be responsible for any costs incurred in excess of that amount. Payment will be sent to the traveler via PayPal. 

  • If the traveler misses their flight due to no fault of Pack Up + Go or the airline, the traveler is responsible for the cost of a new flight to their destination. 

  • If the traveler wishes to upgrade their flight or hotel, add additional activities to their trip within their destination, or extend their trip, or voluntarily change their flight reservations, travelers are responsible for any incurred costs.

  • Peace of Mind Refund Assurance does not protect travelers’ valuables in the case of theft on their trip, or lost luggage. 

  • In the event that a traveler does not wish to travel to the Surprise Destination selected by the Pack Up + Go Team, Peace of Mind does not entitle the traveler to select a new destination for their surprise vacation. 

  • When rescheduling a Trip, Pack Up + Go reserves the right to send travelers to the original destination or to change destinations, depending on pricing and supplier availability. 

If the traveler needs to reschedule their trip, they must alert the Pack Up + Go team at least 24 hours before departure. Once checked in for flights, Pack Up + Go cannot guarantee rescheduling.

You pay for your Trip directly through www.travel.packupgo.com when you are signing up for your Trip.

We use Stripe and Paypal to process all payments and issue any refunds (when applicable, keep reading!).

Stripe, Paypal, and Pack Up + Go guarantee that your payment and personal information are safe and protected.

PROMO CODES:

Trip Promotional Discounts

Discounts in the form of a promo code for any of our Trip Types are redeemable on online purchases with Pack Up + Go via the Website (https://travel.packupgo.com/start). Users are required to redeem a discount by entering the promo code during the checkout of a specified order. Discounts are not valid for cash or cash equivalent. Discounts can be used with gift cards. Users can redeem a single Discount per order, and cannot redeem multiple promo codes on a single order. No adjustments can be made on previous purchases. The discount applies to the entire trip cost, not on a per-traveler basis; meaning that the overall trip expense will be reduced by the specified discount amount regardless of the number of travelers included on a given trip. Trip Promotional Discounts with expiration dates will expire at 11:59:59 PM Eastern Time on the expiration date. All Trip Promotional Discounts related to sales launched to the public will include an expiration date. The expiration date for a given sale will be included in public posts on social media and email, and can also be provided at any time by contacting the Traveler Support Team. Discounts may be linked to a minimum and/or maximum order value. The order value is the sum of all product values excluding the Peace of Mind Refund Assurance costs. Any discount offer is subject to change, alteration, or termination by Pack Up + Go in its sole discretion at any time.

Destination Guide Discounts

Discounts in the form of a promo code are redeemable on online purchases with Pack Up + Go via the Website (https://travel.packupgo.com/start ). Destination Guide Discounts will be offered in one of two ways, a promo code or an automatic discount. For Destination Guide promo code Discounts, users are required to redeem the discount by entering the promo code during the checkout of a specified order. For Destination Guide automatic Discounts, the discount will be applied to the cart automatically if the order meets the conditions of the discount; no code is required. Discounts are not valid for cash or cash equivalent. Destination Guide Discounts cannot be purchased with Pack Up + Go Digital Gift Cards. Users can redeem a single Discount per order, and cannot redeem multiple promo codes on a single order. No adjustments can be made on previous purchases. All Destination Guide discounts expire at 11:59:59 PM Eastern Time on the announced last day of the sale. The last day of the sale will change for each promotional sale. The end date for a given sale will be included in public posts on social media and email. A Discount may be linked to a minimum and/or maximum order value. Any discount offer is subject to change, alteration, or termination by Pack Up + Go in its sole discretion at any time.

PETS:

We’re sure your pets are super cute, but you can’t bring them with you on this Trip. No pets allowed, sorry.

SOCIAL MEDIA + PHOTO SHARING:

You keep all of your ownership rights to any photograph or other content but give us permission to use the photograph as determined by us. By submitting, or otherwise agreeing to our use of, a photograph or other content, including but not limited to photo captions, your name, and the names of any person appearing in the content (collectively, “Content”), you grant us the worldwide, unrestricted, royalty-free, irrevocable, sub-licensable right to (a) publish, publicly display and perform, modify, edit, alter and otherwise use the Content in whole or in part, without further consent, review or participation from you, for any purpose throughout the world (including commercial and promotional) in any medium or format now existing or hereafter created, including but not limited to print or recorded material, websites, social media platforms, and paid and organic marketing placement; and (b) use your name, commentary, and other information about you in connection with the Content. We reserve the right to use, not use, or discontinue using any Content at our sole discretion at any time. 

Make sure that you have permission to take the photograph of any and all people appearing in the photograph and have their permission to have their image and name used by us. If any people pictured are minors, you must obtain their parent or guardian’s express permission to have their image and name used by us. You represent and warrant that you have expressed permission of everyone who appears in the photograph (and their parent or guardian, if applicable) to be photographed and have the photograph and their names used and shared by Pack Up + Go in accordance with these Terms. Before obtaining their permission and sharing the photo with us, send them a copy of or a link to these Terms.

You agree not to submit any Content that:

  • Infringes any intellectual property rights of any other person or third party, including but not limited to copyright and trademark.

  • Defames or invades the privacy or publicity rights of any person, living or deceased, or infringes upon any person’s or third party’s personal, property, or other rights.

  • Is inappropriate, sexually explicit, harassing, abusive, harmful, violent, or otherwise objectionable or offensive in any way.

  • Contains any virus, worm, corrupt file, or other forms of malicious code or content that may harm a website or computer.

  • Violates any law, statute, ordinance, or regulation.

All images, testimonials, and traveler photos on Pack Up + Go social media channels, including, but not limited to, Facebook, Instagram, Twitter, Pinterest, TikTok, LinkedIn, and our blog have been submitted by Pack Up + Go travelers who provided permission for their use. The Trips presented vary in destination, budget, departure city, travel dates, and therefore represent a wide range of Pack Up + Go experiences. Please remember that each Pack Up + Go Trip is unique and depends upon a variety of factors (travel dates, budget, departure city, etc.). All Pack Up + Go Trips are guaranteed to cover accommodations and travel (in the case of our Plane or Train Trips), but no trips are guaranteed to have additional activities included, and thus, your Trip may be different from those shown on social media.

INSTAGRAM GIVEAWAYS

By participating in a Pack Up + Go Instagram giveaway through commenting, you agree to the following Terms of Use:

By commenting on an Instagram giveaway post hosted by Pack Up + Go (Instagram profile here), you agree to comply with Instagram’s terms of service and acknowledge that this promotion is in no way sponsored, endorsed, administered by, or associated with Instagram. By entering, entrants confirm that they are 18+ years of age, release Instagram of responsibility, and agree to Instagram’s terms of use.

Participation in this giveaway is voluntary, and your comment serves as your entry. The giveaway is open to United States citizens and permanent residents. Giveaway entries must be completed on Instagram and entrants must have an Instagram account to complete entry. No purchase is necessary to enter the giveaway. Pack Up + Go reserves the right to disqualify any participant who fails to comply with these terms or engages in any form of misconduct as determined at the Company’s sole discretion.

Entry:

Unless otherwise stated on the specific Instagram giveaway post, the method of entry will require the 3 (three) steps outlined below. To verify this information, users must have a public profile. The specific entry rules for a given giveaway will be included in the caption and will be the official method of entry for that giveaway.

To be considered an official entry, individuals must:

  1. Follow Pack Up + Go (and any other participating brands) on Instagram

  2. Like the giveaway post on Pack Up + Go (and any other participating brands) Instagram Page

  3. Tag another Instagram user or leave a comment on the post

Winner Selection:

Unless otherwise explicitly stated in the caption, 1 (one) winner will be randomly selected to receive the advertised prize. The winner will be randomly selected from eligible entrants using commentpicker.com and random.org on the date following the end of the giveaway. The specific dates of the giveaway will be included in the Instagram caption or pinned as the first comment on the giveaway post. Entries must be submitted by 11:59:59 PM Eastern Time on the last day of the giveaway.

In order to win, Giveaway Administrators must be able to verify that the above actions were taken. Winners will be notified about the status of their entry and will have 48 hours to accept the prize. If not accepted within 48 hours, the prize will be awarded to another entrant. By entering, participants allow us to share their Instagram username to be publicized in the winner announcements.

The winner will ONLY be contacted through the official, verified @packupgo_travel handle. Please stay vigilant and avoid sharing personal and credit card information through direct messages (DM). Pack Up + Go will never ask for your personal financial information through Instagram direct message (DM).

Prize:

Any promo code provided as part of an Instagram giveaway prize cannot be combined with any other discounts or offers, and cannot be applied to Pack Up + Go Trips that have already been purchased. Making a purchase does not increase the chances of winning. Promo code expires at the end of the calendar year of the giveaway. By entering, entrants confirm that they agree to Pack Up + Go’s Terms of Use and Privacy Policy.

COVID-19:

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is known to be contagious and spread from person-to-person contact and possibly by contact with contaminated surfaces and objects or in the air. Evidence has shown that COVID-19 can cause serious and potentially life-threatening illness and death.

Pack Up + Go cannot prevent travelers from becoming exposed to, contracting, or spreading COVID-19 while utilizing Pack Up + Go services. It is not possible to prevent against the presence of the disease. Therefore, if you choose to travel during the pandemic, you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19.

By agreeing to these Terms of Use, you understand the above warning concerning COVID-19 and choose to accept the risk of contracting COVID-19 by traveling during a global pandemic. You accept the risk of being exposed to, contracting, and/or spreading COVID-19 in order to utilize Pack Up + Go travel planning services.

By agreeing to these Terms of Use, you release and waive the right to bring suit against Pack Up + Go and its owners, officers, directors, managers, agents, employees, or other representatives in connection with exposure, infection, and/or spread of COVID-19 related to utilizing Pack Up + Go’s services. You understand that this waiver means giving up the right to bring any claims including for personal injuries, death, disease or property losses, or any other loss, including but not limited to claims of negligence and give up any claim to seek damages, whether known or unknown, foreseen or unforeseen. 

All travelers have the ability to postpone their travel dates for a nominal fee until the travel reservations are finalized. Once finalized, all changes are subject to the rules and regulations of travel providers and may result in additional expenses and fees.

ZERO TOLERANCE POLICY:

Pack Up + Go will under no circumstances tolerate disrespectful, hateful, harmful, or inconsiderate language or actions towards members of the Pack Up + Go team, hotel partners, tour operators, or activity providers. Any language or actions deemed inconsistent with the rules and regulations set forth in these Terms or the Terms of hotels, tour operators, activity partners, or local, state, or national regulations are immediate grounds for the termination of Pack Up + Go service for the remainder of the Trip. Any travelers who breach this agreement or the regulations set forth by any third party suppliers for a Trip will not be permitted to travel with Pack Up + Go in the future. No additional service from Pack Up + Go or refunds will be granted or guaranteed in the event that these Terms are breached.

CLOUD 9 CLUB LOYALTY AND REFERRAL PROGRAM:

1. How the program works, Membership & Eligibility

Via the loyalty program, Pack Up + Go rewards customers’ loyalty for purchasing Pack Up + Go’s vacations by initiating all kinds of related commercial actions in the Cloud 9 Club Loyalty Program (the “Program”). For a purchase to qualify under the Program, the customer must be enrolled in the Program and be signed into their online account at the time of a certain purchase via the Website. The customer enrolled in the Program can earn “Pack Up + Go Points” (or “points”) taking actions such as making Pack Up + Go Trip purchases and making referrals to first time customers, which are indicated on the Website via the Cloud 9 Club landing page. Once a customer earns a certain number of points, the customer may be eligible for certain benefits and rewards applicable to the Program. Pack Up + Go is free to change the precise benefits of the Program from time to time and all rewards are offered on a limited basis as stated in the details of the Program and cannot be combined with other promotions or actions. Eligible purchases and other opportunities to earn points will be published on the Website or may be published through other media (e.g. in marketing communications, social media, etc.). The specifics of each purchase eligible under the Program shall be published on the Website and these specifics shall supplement these Terms. 

1.1. Eligible customers may only enroll in the Program by visiting the Website and after creating an online Pack Up + Go account (the “Account”) as specified on the Website. Each customer must be 18 years or older to become eligible for the Program and to subscribe to a Pack Up + Go Account. All customers with an Account are automatically enrolled in the Program.

1.2. The customer is required to provide their email address and to create a password to enroll. After a purchase has been made, the customer’s name, mailing address, birth date, and mobile phone number shall be associated with the account and such information can be used for promotional purposes and mailings. By creating an Account on the Website, the customer agrees with these Terms. Unless otherwise provided for, no actual purchase is required to be enrolled in the Program. A customer holding an Account is referred to as a “Member”.

Pack Up + Go uses some personal information to provide you with rewards and administer our rewards program.

The Personal Data processed includes:

  • Name

  • Email

  • Phone Number

  • Address

  • Date of Birth

The Non-Personal Data processed includes:

  • Transactional Data

  • Account Creation Date

1.3. Each Account made up in the Program can only be associated with one single email address and one individual customer. In the event of a dispute over ownership of the Account, the customer will be deemed to be the authorized account holder of the email address submitted at the time of enrollment. For purposes of these Terms, the "authorized account holder" is the natural person who is assigned to the submitted email address by an internet provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Our Program only applies to customers of the Pack Up + Go Website and are no part of any other contractual relationship or does not constitute any other contractual benefits. Rewards in the form of a discount code can therefore only be used on the Website.

2. Earning Pack Up + Go Points

Earning Pack Up + Go Points Under the Program, you earn “Pack Up + Go Points” (or “points”) by completing different actions and by making online purchases of Pack Up + Go products. 

Points will expire after a period of 24 months if not redeemed.

3. Redeeming Rewards and Discounts

When a Member has enough points they are offered the option to redeem their saved points in the form of a certain reward. Rewards are non-changeable and non-refundable after redemption.

Rewards, benefits and/or points earned through the Program have no cash value, are non-transferable (to third parties or to other platforms), and you have no property rights in or to rewards or other Program benefits. Points credited to Member’s Account will be decreased or reversed, as applicable, if part or all of the purchase is returned or canceled or if the credit is obtained through fraudulent or other activity that violates these Terms. Pack Up + Go is not responsible for rewards, benefits, and/or points lost or redeemed due to fraudulent activity and is entitled to refuse the granting of any reward in cases of fraud or breach of contract on the customer’s part. The sale, barter, transfer, or assignment of any rewards or benefits offered through the Program, other than by Pack Up + Go, is expressly prohibited.

To redeem points for a reward, Members must reach out to the Traveler Support Team at hello@packupgo.com to exchange their points for a reward. The reward will be provided in the form of a promo code to be used on either www.packupgo.com (for Destination Guides) or travel.packupgo.com (for Trip Purchases). The amount of points for the reward selected will be deducted from the Member’s overall point balance. Members may request their point balance at any time by emailing the Traveler Support Team at hello@packupgo.com.

If the customer has concerns that a purchase or other activity was not properly assigned to their Account, the customer may contact the Pack Up + Go Traveler Support Team at hello@packupgo.com or within a period of 45 days after the date the purchase or order concerned took place and by providing all relevant details and Account information. Pack Up + Go is not responsible for late notifications about purchases or other Program activities not being credited to an Account.

Rewards in the form of a Discount are redeemable on the Member’s next online purchase with Pack Up + Go via the Website. All discounts will be provided to customers in the form of a promo code. Promo codes issued as part of the Cloud 9 Club Loyalty and Referral Program redemption process (effective January 16, 2024) will expire 1 year at 11:59:59 PM Eastern Time from the date they are provided to the customer. Customers are required to redeem a discount during the checkout of a specified order. Discounts are not valid for cash or cash equivalent and cannot be accumulated with other promotions or other contractual benefits offered unless expressly stated otherwise. No adjustments can be made on previous purchases. A reward in the form of a Discount is non-transferable. Offer subject to change, alteration, or termination by Pack Up + Go in its sole discretion at any time. Members are not permitted to redeem more than one Discount per purchase/order. The order value is the sum of all product values excluding the Peace of Mind Refund Assurance costs. A Discount may be linked to a maximum value.

2.              We Do Not Sell Travel Products:

PLEASE NOTE: PACK UP + GO IS NOT A TRAVEL PROVIDER, WE ARE A TRAVEL AGENCY. WE ARE SUBJECT TO THE RULES AND REGULATIONS SET FORTH BY AIRLINES, HOTEL PROVIDERS, AND OTHER THIRD-PARTY PROVIDERS.

(a)            We sell a variety of travel-related products from different airline and hotel providers (collectively, the “Providers”). Each Provider has its own terms and conditions that are applicable to your particular Trip in addition to our general terms and conditions, and you should make sure you understand them.

(b)           We are acting as a Travel Agency or “Booking Agent” for products and services that are not directly supplied by us (e.g., air carriage, hotel accommodations, etc.) We are not a co-vendor of such products and services. You will be entering into a separate contract with such Providers in connection with such products and services.

3.              Order Acceptance and Cancellation:

(a)            The purchase of Services by Pack Up + Go constitutes a contractual agreement between You (including all travelers on the Trip, hereinafter collectively referred to as “You” and “Your”) and Pack Up + Go and represents your acceptance of the Pack Up + Go Terms set out herein.

(b)          You agree that your order is an offer to buy, under these Terms, the Service listed in your order. All orders must be accepted by us or we will not be obligated to sell the Service to you. We may choose not to accept orders at our sole discretion, even after we send you a confirmation email with your order number and details you have ordered.

4.              Prices and Payment Terms:

(a)             All prices, discounts, and promotions posted on this Site are subject to change without notice. The price charged for a Service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. We strive to display accurate price information, however we may, on occasion, make inadvertent typographical errors, inaccuracies or omissions related to pricing and availability. We reserve the right to correct any errors, inaccuracies, or omissions at any time and to cancel any orders arising from such occurrences. 

(b)           Posted prices for Surprise Vacations do not include food, dining, or any activities including tour guides. Posted prices for Destination Guides do not include any reservations or bookings.

(c)            From time to time, we may offer promotions on the Site that may affect pricing and that are governed by terms and conditions separate from these Terms. If there is a conflict between the terms for a promotion and these Terms, the promotion terms will govern.

(d)           Terms of payment are within our sole discretion and, unless otherwise agreed by us in writing, all payments must be made directly through the Website and received by us before our acceptance of an order. We accept all Credit Cards through Stripe and PayPal for all purchases. You represent and warrant that: (i) the credit card information you supply to us is true, correct and complete; (ii) you are duly authorized to use such credit card for the purchase; (iii) charges incurred by you will be honored by your credit card company; and (iv) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any, regardless of the amount quoted on the Site at the time of your order.

5.              Shipments; Delivery; Title and Risk of Loss.

(a)            Our general practice is to send documents to our customers through the United States Postal Service mail and through email.

(b)           Shipping and delivery dates are estimates only and cannot be guaranteed. We are not liable for any delays in shipments.

6.              Prohibited Uses.

You may not reverse engineer, disassemble, or decompile, derive code or materials from, or capture any source, scripts, layouts, design, metadata, or other information accessible through our services (including, without limitation, data packets transmitted to and from our services), or analyze, decipher, “sniff”, derive code or materials from any packet stream to our from our services, or attempt any of the foregoing. You expressly waive any legal rights you may have to do any of the foregoing, including any claim that such activities constitute “fair use” or are for “interoperability purposes” under the Digital Millennium Copyright Act.

Further, in using our services, you may not:

(a)            Violate these Terms of Use, infringe upon our rights or the rights of others (including, without limitation, intellectual property rights, rights of privacy such as unauthorized disclosure of a person’s name or email or physical address or phone number, and rights of publicity), or violate any laws;

(b)           Conduct or solicit illegal or other activity that in any way harms us or any of our affiliates and business partners;

(c)            Post, email, message, or otherwise make available through the service, any content that (i) incites, advocates, or expresses pornography, obscenity, vulgarity, profanity, hatred, bigotry, racism, or gratuitous violence; (ii) is intended to threaten, stalk, defame, defraud, degrade, victimize, or intimidate an individual or group of individuals for any reason; (iii) is illegal or violates any laws, including laws related to adult activities and content, child pornography, criminal activities, gambling, and drugs, or (iii) promotes an illegal or unauthorized copy of another person’s copyrighted work, such as providing pirated music or videos or computer programs, or links to such materials;

(d)           Engage in commercial activities or sales, such as contests, sweepstakes, barter, advertising, or the buying or selling of “virtual” items, without our prior written permission;

(e)            Disguise the origin of any message, communication, or transmittal you send to us through our services;

(f)            Use any robot, spider, scraper, or other automated or manual means to access our services, or copy any content or information on our services;

(g)           Attempt to gain unauthorized access to any portion of our services or any related networks or systems by hacking, password “mining”, or any other illegitimate means;

(h)           Probe, scan, test the vulnerability of or breach the authentication measures of, our services or any related networks or systems;

(i)             Modify or reroute or attempt to reroute our services;

(j)             Link to our services from any unsolicited bulk messages or unsolicited commercial messages (“spam”);

(k)           Utilize framing, squeeze back, overlay or other techniques to enclose or display our services or any content on our services, with any other software or content of a third party; or

(l)             Take any action that places a disproportionately large load on our services or any related networks or systems.

(m)          We reserve the right, but not the obligation, to investigate and take appropriate legal action against anyone who we believe is violating these Terms of Use, including without limitation, removing any materials, suspending or terminating the registration of such violators, or suspending or terminating their right to use our services.

7.              Dissatisfaction, Cancellation, and Refunds.

BY AGREEING TO THESE TERMS AND CONDITIONS, YOU GIVE PACK UP + GO PERMISSION TO SELECT THE DESTINATION FOR YOUR TRIP AND RELINQUISH CONTROL OVER YOUR DESTINATION. AS SUCH, PACK UP + GO IS NOT LIABLE IF YOU ARE DISSATISFIED WITH YOUR TRIP AND WILL NOT OFFER REFUNDS UNDER THESE CIRCUMSTANCES.

WE DO NOT GUARANTEE THAT CANCELLED TRIPS WILL BE FULLY REFUNDED.

(a)            To cancel your trip, you must immediately call us at 412-448-2700. Cancellation fees and refunds will be given in accordance with the Pack Up + Go cancellation policy. Refund amounts are subject to change and are based on, but not limited to, the following factors: time until departure at the point of cancellation, status of Peace of Mind Refund Assurance with the order, and third-party refund policies.

(b)           Refunds are considered on a case-by-case basis.  Refunds are subject to the transportation and accommodation providers (“Providers”) through which your reservations are made. We make no guarantee or promise as to whether Providers will issue a refund. We therefore strongly recommend that you fully insure your Trip. Any refund will be credited back to the same payment method used to make the original purchase on the Site.

(c)            Right of California Customers to Make Claim on the California Travel Consumer Restitution Fund:

(i)             You may be eligible for a refund for losses to a registered seller of travel that participates in the California state refund program.  If you were located in California at the time of your purchase, you may have a right to file a claim for losses with the California Travel Consumer Restitution Corporation. THE FOREGOING DISCLAIMER SHALL APPLY EVEN IF YOUR REMEDIES UNDER THIS AGREEMENT FAIL OF THEIR ESSENTIAL PURPOSE. YOU MAY HAVE ADDITIONAL RIGHTS UNDER APPLICABLE LAW THAT PRECLUDE OR LIMIT THE EXCLUSION AND DISCLAIMERS ABOVE.

Pack Up + Go shall not be liable for any loss, injury, expense or damage to persons or property resulting, directly or indirectly, from the acts or omissions of independent travel suppliers, including but not limited to delays, overbookings, cancellation of services, cessation of operations, accidents, failures of equipment, or changes in fares, itineraries or schedules.

Neither Pack Up + Go nor airline or accommodation suppliers, or their respective subagents, shall be held liable for loss or damage to property or injury of person caused by reason of any act, omission, defect or negligence by any other hotel agency, transportation company or party providing such services or facilities.

All parties concerned are not liable for any claim arising out of or in connection with carriage or other services or features otherwise performed or occurring in connection with this package, except as provided in the conditions of carriage for the transportation company and the passenger tickets issued in conjunction with this package. Pack Up + Go is not responsible under any circumstances for any injury or damages you may suffer in connection with your air or ground transportation.

10.           Goods Not for Resale or Export. You represent and warrant that you are buying the Trip from the Site for your own personal or household use only, and not for resale or export.

11.           Trips Only Available to Permanent Legal Residents of the United States Citizens.  Due to complications that can arise when dealing with travel for citizens of countries other than the United States, only permanent legal residents of the United States can purchase Trips from Pack Up + Go, and Pack Up + Go reserves the right to refuse to provide a Trip to any person who is not a permanent legal resident of the United States.

12.           Privacy. We respect your privacy and are committed to protecting it. Our Privacy Policy governs the processing of all personal data collected from you in connection with your purchase of products or services through the Site.

13.           Indemnity. You agree to defend, indemnify, and hold us harmless from and against all claims, losses, liability, costs, and expenses (including attorneys’ fees) arising from your use of our services, violation of these Terms of Use, or violation of any third-party rights. YOU AGREE TO WAIVE ANY AND ALL LAWS THAT MAY LIMIT THE EFFICACY OF ANY RELEASES CONTAINED IN THESE TERMS OF USE, INCLUDING THE PROVISIONS OF CALIFORNIA CIVIL CODE SECTION 1542.

14.           Force Majeure. We will not be liable or responsible to you, nor be deemed to have defaulted or breached these Terms, for any failure or delay in our performance under these Terms when and to the extent such failure or delay is caused by or results from acts or circumstances beyond our reasonable control, including, without limitation, acts of God, flood, fire, earthquake, explosion, governmental actions, war, invasion or hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest, national emergency, revolution, insurrection, epidemic, pandemic, lockouts, strikes or other labor disputes (whether or not relating to our workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials, materials or telecommunication breakdown or power outage.

15.           Governing Law and Jurisdiction. This Site is operated from the United States. All matters arising out of or relating to these Terms are governed by and construed in accordance with the internal laws of the Commonwealth of Pennsylvania without giving effect to any choice or conflict of law provision or rule (whether of the Commonwealth of Pennsylvania or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than those of the Commonwealth of Pennsylvania.

16.           Dispute Resolution and Binding Arbitration.

YOU AND PACK UP + GO ARE AGREEING TO GIVE UP ANY RIGHTS TO LITIGATE CLAIMS IN A COURT OR BEFORE A JURY, OR TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE ACTION WITH RESPECT TO A CLAIM. OTHER RIGHTS THAT YOU WOULD HAVE IF YOU WENT TO COURT MAY ALSO BE UNAVAILABLE OR MAY BE LIMITED IN ARBITRATION.

ANY CLAIM, DISPUTE OR CONTROVERSY (WHETHER IN CONTRACT, TORT OR OTHERWISE, WHETHER PRE-EXISTING, PRESENT OR FUTURE, AND INCLUDING STATUTORY, CONSUMER PROTECTION, COMMON LAW, INTENTIONAL TORT, INJUNCTIVE AND EQUITABLE CLAIMS) BETWEEN YOU AND US ARISING FROM OR RELATING IN ANY WAY TO YOUR PURCHASE OF THE TRIP THROUGH THE SITE, WILL BE RESOLVED EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION.

(a)            The aggrieved party shall bring all grievances before a single arbitrator mutually-selected by the parties, with the arbitration proceeding situated and convened in Pittsburgh, Pennsylvania, regardless of the residence or principal place of business of either party. The arbitration will be administered by a local chapter of the American Arbitration Association (“AAA”) in accordance with the Consumer Arbitration Rules (the “AAA Rules”) then in effect.  (The AAA Rules are available at www.adr.org/arb_med or by calling the AAA at 1-800-778-7879.) The Federal Arbitration Act will govern the interpretation and enforcement of this section.

                        The arbitrator will have exclusive authority to resolve any dispute relating to arbitrability and/or enforceability of this arbitration provision, including any unconscionability challenge or any other challenge that the arbitration provision or the agreement is void, voidable, or otherwise invalid. The arbitrator will be empowered to grant whatever relief would be available in court under law or in equity. Any award of the arbitrator(s) will be final and binding on each of the parties and may be entered as a judgment in any court of competent jurisdiction. Each party is responsible for their own costs of suit and reasonable attorneys’ fees as set by the arbitrator.

(b)           You agree to an arbitration on an individual basis. In any dispute, NEITHER YOU NOR PACK UP + GO WILL BE ENTITLED TO JOIN OR CONSOLIDATE CLAIMS BY OR AGAINST OTHER CUSTOMERS IN COURT OR IN ARBITRATION OR OTHERWISE PARTICIPATE IN ANY CLAIM AS A CLASS REPRESENTATIVE, CLASS MEMBER OR IN A PRIVATE ATTORNEY GENERAL CAPACITY. The arbitrator may not consolidate more than one person’s claim(s) and may not otherwise preside over any form of a representative or class proceeding. The arbitrator has no power to consider the enforceability of this class arbitration waiver and any challenge to the class arbitration waiver may only be raised in a court of competent jurisdiction.

            If any provision of this arbitration agreement is found unenforceable, the unenforceable provision will be severed, and the remaining arbitration terms will be enforced.

17.           Assignment. You will not assign any of your rights or delegate any of your obligations under these Terms without our prior written consent. Any purported assignment or delegation in violation of this Section is null and void.  No assignment or delegation relieves you of any of your obligations under these Terms.

18.           No Waivers. The failure by us to enforce any right or provision of these Terms will not constitute a waiver of future enforcement of that right or provision. The waiver of any right or provision will be effective only if in writing and signed by a duly authorized representative of Pack Up + Go.

19.           No Third-Party Beneficiaries. These Terms do not and are not intended to confer any rights or remedies upon any person other than you.

20.           Notices.

(a)            To You. We may provide any notice to you under these Terms by: (i) sending a message to the email address you provide; or (ii) by posting to the Site.  Notices sent by email will be effective when we send the email and notices we provide by posting will be effective upon posting. It is your responsibility to keep your email address current.

(b)           To Us. To give us notice under these Terms, you must contact us as follows: by personal delivery, overnight courier, or registered or certified mail to Pack Up + Go, LLC, 808 Penn Avenue, #6, Pittsburgh, PA 15222.  Notices provided by personal delivery will be effective on the date delivered. Notices provided by overnight courier will be effective one (1) business day after they are sent. Notices provided by registered or certified mail will be effective three (3) business days after they are sent.

21.           Severability. If any provision of these Terms is invalid, illegal, void or unenforceable, then that provision will be deemed severed from these Terms and will not affect the validity or enforceability of the remaining provisions of these Terms.

22.           Entire Agreement. Our email order confirmation, these Terms, and our Privacy Policy will be deemed the final and integrated agreement between you and us on the matters contained in these Terms.
